The general terms and conditions of sale (hereinafter referred to as the "GTC") govern all relations between :
68 'Ski Legend, a simplified joint stock company with a single shareholder, registered in the Annecy Trade and Companies Register under number 841 245 665, whose registered office is located at 145 chemin de Rovagny 74290 Talloires-Montmin (hereinafter referred to as "Dynamic") and
The natural person who orders one or more product(s) (hereinafter referred to as "the Customer") on the company's Website accessible at the following address: www.dynamic.ski (hereinafter referred to as the Dynamic.ski website).

Preamble

It is specified that the orders placed on the site www.dynamic.ski are strictly reserved for consumers. The purchase of products by a professional with a view to resale is prohibited.
For any order placed by a professional, our Customer Relations Service is at your disposal (contact@dynamic.ski). Dynamic reserves the right to modify its Terms and Conditions of Sale at any time. In this case, the applicable conditions will be those in force at the date the order is taken into account.
In case of contradiction between these GCS and any other document on the website, these GCS shall prevail.

Article 1. Acceptance by the customer

The Customer is fully advised that it is not technically possible to place an order online without first having read and duly accepted these terms and conditions. Any order placed on the www.dynamic.ski website implies full and unreserved acceptance of these contractual terms and conditions. This will be materialized by electronically checking the box "I have read and accept the general terms and conditions" and then clicking on the button "Validate the order".

Article 2. Creation of a Customer Account

Prior to any order, the Customer is invited to register on the site: www.dynamic.ski and provide information concerning him/her, such as his/her surname, first names, postal address for delivery and invoicing, telephone number and e-mail address. This information is necessary for the management of orders and the commercial relationship between Dynamic and the Customer. Consequently, failure to provide the requested information is equivalent to renouncing the creation of an account. When registering, the Customer validates, on the one hand, his email address as an identifier and, on the other hand, a password, allowing him to identify himself to the site servers for placing the order and during subsequent connections. Similarly, by registering on the Dynamic.ski website, the Customer certifies that he is of legal age and has full legal capacity to enter into a contract with Dynamic. The Customer certifies that the information thus provided is true, accurate, sincere and up to date. Under no circumstances may Dynamic be held liable for the consequences of an erroneous or non-updated mention. The Customer thus undertakes to update his or her account in all cases of change of address, change of telephone number or e-mail address.

Article 3. Product information

The website www.dynamic.ski offers a selected range of products. In accordance with Articles L 111-1 and L 113-3 of the French Consumer Code, the essential characteristics and prices of our products sold electronically are available on the online sales site www.dynamic.ski. The Customer may also consult the illustrative photographs, it being specified that the products delivered may differ slightly from the items photographed. In all cases where the Customer wishes to obtain technical details or additional information on any of the products sold on the Site, Customer Service is at his entire disposal:

Article 4. Completion of the order

By order, it must be understood any order concerning the products appearing on the site: www.dynamic.ski, and accepted by him.
All the steps leading to the sale are specified on the site www.dynamic.ski. The customer has the possibility, before definitively validating his order, to check the details, its total price and to correct any errors. As soon as the order is validated by the Customer, Dynamic will acknowledge receipt of the order electronically as soon as possible. However, the sale is not considered final until the order confirmation has been sent to the Customer, specifying the shipment of the items.
In certain cases, incorrect address or other problem that may arise on the Customer's account, Dynamic reserves the right to block the Customer's order until the problem is resolved.

Article 5. Product prices

The prices of the products are indicated on the product sheet in Euros and taxes included for the European Union and taxes not included outside the EU, excluding delivery costs. The Customer is informed of the delivery costs of the products before the final validation of his order. All orders are payable in Euros. In accordance with the provisions of article L.221-11 of the Consumer Code, the Customer receives upon delivery, for each of the items, written confirmation of the price paid detailing the price of the items and the delivery costs, if applicable, charged to him.

Article 6. Payment

The payment of orders is made immediately on the Internet, according to the instructions given for this purpose during the validation process (click on: Order confirmation). The Customer is advised that Dynamic does not collect or keep any information specific to the Customer's bank details and that payment for orders is made to our partners by credit card. The following cards are accepted: Carte Bleu (CB), Visa, Mastercard. All banking transactions are carried out on the Reserved Area of the website www.dynamic.ski and in a secure manner. The site makes available the standard SSL "Secure Sockets Layer" secure form issued by the Clic&Pay platform which encrypts information in order to protect the contents related to personal information and means of payment. As long as necessary, the customer certifies that he is the holder of the bank card for which he is providing the information and that he has all the necessary rights to use it. Any order validated by the Customer is not considered effective by Dynamic until after acceptance by the Clic&Pay payment Internet server.
Dynamic reserves the right to suspend any order management, or cancel the order, in the event of refusal of payment authorisation by officially accredited organisations or in the event of non-payment.

Article 7. Preparation of the order

The products ordered are packed in cartons with "Dynamic" adhesive tape. It is important that the customer checks that this tape is still intact before accepting receipt of the package. The products are offered within the limits of available stocks. If it turns out that a product ordered is in fact unavailable, Dynamic will notify the Customer as soon as possible by e-mail and offer to reschedule a delivery. If the proposed deadlines are not appropriate, the Customer may request the cancellation of the sale of the unavailable product and obtain, if necessary, a refund of the corresponding sums already paid.

Article 8. Delivery

Delivery is made to the address indicated by the Customer. It is the Customer's responsibility to verify the accuracy of his or her information before validating the order.
Delivery charges may be applied by Dynamic at the time of the order, depending in particular on the type of product and the place of delivery. These delivery costs are indicated legibly before any order and payment validation. In accordance with the provisions of the French Consumer Code, the delivery of the ordered items shall take place within the timeframe communicated by Dynamic and, if no delivery time is indicated, no later than thirty (30) days from the validation of the order. In the event of failure to deliver within these deadlines, the Customer may terminate the agreement, by registered letter with acknowledgement of receipt or in writing on another durable medium, if, after having instructed Dynamic, according to the same terms, to make the delivery or provide the service within a reasonable additional period of time, Dynamic has not performed within this period. The Agreement shall be deemed to have been dissolved upon Dynamic's receipt of the letter or writing informing Dynamic of such dissolution, unless delivery has taken place in the meantime.
Dynamic is fully released from its delivery obligation as of the receipt of the package by the Customer. The risks of loss, theft or deterioration of the products are therefore transferred to the Customer. Delivery costs are, unless otherwise specified, at the expense of the Customer and vary according to the type of product ordered and the Customer's address. The price of deliveries are indicated before confirmation of the order.

Article 9. Defective product or delivery error

Upon delivery, the Customer must check the general condition of the package and the condition of the products delivered in order to report without delay the presence of any damage. If it turns out that products are damaged or do not correspond to the order, the Customer is asked to write all his reservations on the delivery slip and to clearly indicate the nature of the damage and/or the error. Any anomaly concerning the articles (damage, missing article compared to the order form, damaged or opened package, broken or defective article...) must be imperatively reported within seventy-two (72) hours following delivery in writing to contact@dynamic.ski. In the event that the customer has accepted the delivery and wishes to make a return, the customer shall follow the return procedure described in Article 13 below.

Article 10. International Orders

Any product delivered to another member country of the European Union is automatically subject to VAT in France according to the European Union regulations in force. Only orders to residents of countries outside the European Union are invoiced free of tax, the VAT declaration being made locally at the initiative of the Customer, who is the beneficiary of the product. It is particularly advised to the Customer resident outside the European Union to inquire about the formalities relating to the importation, customs duties and possible taxes due to the importation in his country of the products purchased on the site. It is likewise specified that the Customer is required to ensure that he obtains from his national authorities any authorisation required for their importation.
For all export orders outside Europe, taxes and customs duties may be applied, and will be charged to the Customer upon receipt of the package.

Article 11. Retention of title and transfer of risks

Dynamic retains full ownership of the goods sold until full payment of the price and shipping costs.

Article 12. Right of withdrawal

In accordance with article L.221-28 of the Consumer Code, the right of withdrawal cannot be exercised for products made to the consumer's specifications or personalised: this includes skis and bindings, or any other Product assembled and adjusted to the skier's measurements.
By virtue of article L.221-28 of the French Consumer Code, the Customer has a period of fourteen (14) clear days from delivery to exercise his right of withdrawal and renounce the purchase of any product ordered, without having to justify or pay any penalties, except for the cost of return, which remains at his expense.
To exercise its right of withdrawal, the Customer shall inform Dynamic of its clear and unequivocal desire to withdraw by completing the online withdrawal form: Return Form

The Customer therefore has a period of 14 days following the sending of his withdrawal request to return the product ordered to Dynamic to Customer Service (Returns) under the conditions described in Article 13 below. The costs of returning the products shall be borne by the Customer. The Customer is fully advised that the right of retraction authorizes him to test the product, i.e. to proceed only with the manipulations necessary to establish the nature, characteristics and proper functioning of the good ordered. The Customer's responsibility will be engaged for all other manipulations leading to the depreciation of the product and may lead to a refusal to refund the price of the returned products and their reshipment to the Customer by Dynamic.
In accordance with Article L.221-24 of the French Consumer Code, Dynamic shall reimburse all sums paid by the Customer, including delivery costs, using the same payment method that the Customer chose for the initial transaction. In any event, this reimbursement shall not incur any costs for the Customer. Dynamic may defer the refund until the goods are recovered. However, Dynamic shall not be obliged to reimburse any additional costs if the Customer has expressly chosen a more expensive delivery method than the standard delivery method.

Article 13. Return Procedure

For the return of the goods within the framework of the guarantees recalled in article 13 above or within the framework of the exercise of the right of retraction referred to in article 14 above, the Customer shall follow the procedure described below :
The Customer shall fully complete and sign the warranty return or return for cancellation form and then send it to Dynamic's Customer Service (returns) department by e-mail to the following address: contact@dynamic.ski or by post to Dynamic, 145 chemin de Rovagny, 74290 Talloires Montmin, France.
Upon receipt of the Dynamic return form, Dynamic shall send the Customer an acknowledgement of receipt containing a return number and specifying the practical procedures for returning the package. It is recommended to print and paste this return number on the package to facilitate the processing of the request.
The Customer shall package the product according to the return instructions in its original packaging, complete with original labels, accessories, instructions for use and warranty ;
In the event of exercising the right of retraction, the Customer shall organize the return and in any event no later than 14 days following the dispatch of his return request to Dynamic. In the event that the warranty is exercised, the Customer shall comply with the return procedure indicated by Dynamic.
Upon receipt of the package, Dynamic shall contact the Customer by e-mail or telephone and confirm, depending on the reason for the return and under the conditions mentioned above, either the replacement by a new product or a refund equivalent to the price of the returned product on the date of the original purchase.

Article 14. Legal guarantees

Dynamic s’engage à remettre au Client un bien ou un service conforme à sa demande.
Tous les produits de Dynamic bénéficient d’une garantie de conformité et d’une garantie contre les vices cachés d’une durée de (3) ans selon les modalités décrites ci-après. En cas de mise en jeu de l’une ou l’autre de ces garanties, les produits sont remplacés à neuf par un produit identique ou présentant des caractéristiques équivalentes ou supérieures, si le produit n’est plus commercialisé par Dynamic. Pour mettre en œuvre les garanties, le Client contacte le Service Clients par courrier électronique à l’adresse suivante : contact@dynamic.ski, se voit attribuer un numéro de dossier et suit la procédure décrite à l’article 13.
Dans le cadre de la garantie légale de conformité il est rappelé les principes suivants issus du Code de la Consommation : Article L217-4 : Le vendeur livre un bien conforme au contrat et répond des défauts de conformité existant lors de la délivrance. Il répond également des défauts de conformité résultant de l’emballage, des instructions de montage ou de l’installation lorsque celle-ci a été mise à sa charge par le contrat ou a été réalisée sous sa responsabilité. Article L217-5 : Le bien est conforme au contrat : 1° S’il est propre à l’usage habituellement attendu d’un bien semblable et, le cas échéant :- s’il correspond à la description donnée par le vendeur et possède les qualités que celui-ci a présentées à l’acheteur sous forme d’échantillon ou de modèle ;- s’il présente les qualités qu’un acheteur peut légitimement attendre eu égard aux déclarations publiques faites par le vendeur, par le producteur ou par son représentant, notamment dans la publicité ou l’étiquetage ; 2° Ou s’il présente les caractéristiques définies d’un commun accord par les parties ou est propre à tout usage spécial recherché par l’acheteur, porté à la connaissance du vendeur et que ce dernier a accepté. Article L217-7 : Les défauts de conformité qui apparaissent dans un délai de vingt-quatre mois à partir de la délivrance du bien sont présumés exister au moment de la délivrance, sauf preuve contraire. Pour les biens vendus d’occasion, ce délai est fixé à six mois. Le vendeur peut combattre cette présomption si celle-ci n’est pas compatible avec la nature du bien ou le défaut de conformité invoqué. Article L217-8 : L’acheteur est en droit d’exiger la conformité du bien au contrat. Il ne peut cependant contester la conformité en invoquant un défaut qu’il connaissait ou ne pouvait ignorer lorsqu’il a contracté. Il en va de même lorsque le défaut a son origine dans les matériaux qu’il a lui-même fournis. Article L217-9 : En cas de défaut de conformité, l’acheteur choisit entre la réparation et le remplacement du bien. Toutefois, le vendeur peut ne pas procéder selon le choix de l’acheteur si ce choix entraîne un coût manifestement disproportionné au regard de l’autre modalité, compte tenu de la valeur du bien ou de l’importance du défaut. Il est alors tenu de procéder, sauf impossibilité, selon la modalité non choisie par l’acheteur. Article L217-10 : Si la réparation et le remplacement du bien sont impossibles, l’acheteur peut rendre le bien et se faire restituer le prix ou garder le bien et se faire rendre une partie du prix. La même faculté lui est ouverte : 1° Si la solution demandée, proposée ou convenue en application de l’article L. 217-9 ne peut être mise en œuvre dans le délai d’un mois suivant la réclamation de l’acheteur ; 2° Ou si cette solution ne peut l’être sans inconvénient majeur pour celui-ci compte tenu de la nature du bien et de l’usage qu’il recherche. La résolution de la vente ne peut toutefois être prononcée si le défaut de conformité est mineur. Article L217-11 : L’application des dispositions des articles L. 217-9 et L. 217-10 a lieu sans aucun frais pour l’acheteur. Ces mêmes dispositions ne font pas obstacle à l’allocation de dommages et intérêts. Article L217-12 : L’action résultant du défaut de conformité se prescrit par deux ans à compter de la délivrance du bien.Article L217-13 : Les dispositions de la présente section ne privent pas l’acheteur du droit d’exercer l’action résultant des vices rédhibitoires telle qu’elle résulte des articles 1641 à 1649 du code civil ou toute autre action de nature contractuelle ou extracontractuelle qui lui est reconnue par la loi.
Dans le cadre de la garantie des vices cachés, il est rappelé les principes suivants issus du Code de civil : Article 1641: Le vendeur est tenu de la garantie à raison des défauts cachés de la chose vendue qui la rendent impropre à l’usage auquel on la destine, ou qui diminuent tellement cet usage que l’acheteur ne l’aurait pas acquise, ou n’en aurait donné qu’un moindre prix, s’il les avait connus. Article 1648 alinéa 1 du Code civil : L’action résultant des vices rédhibitoires doit être intentée par l’acquéreur dans un délai de deux ans à compter de la découverte du vice.
Il est en outre précisé que cette garantie couvre uniquement les vices cachés affectant les produits et exclut notamment de son champ d’application les conséquences résultant d’accident, de l’usure normale, d’une mauvaise utilisation ou de mauvais traitement, du non-respect des consignes d’utilisation, du manque d’entretien ou d’une utilisation non conforme desdits produits.

Article 16. Use of personal data

Dynamic declares and guarantees to the Customer that it acts in full compliance with the provisions of Law No. 78-17 of January 6, 1978, relating to computers, files and freedoms. By placing an order on the Dynamic.ski website, the Customer authorises the collection, use and transfer of his/her personal data within the framework of the legal provisions regarding the processing of personal data.
The information communicated by the Customer in the context of orders is intended for Dynamic and is used for processing and tracking your orders, after-sales service for the products ordered and for marketing and customer relationship management. This data may be transmitted to Dynamic's service providers for the purpose of processing orders and after-sales service as well as for marketing and customer relationship management purposes. This data may also be communicated to Dynamic's partners for canvassing purposes by non-electronic means, in particular by post or telephone. The Customer may at any time object to this communication by providing proof of his or her identity, by letter addressed to : 68 'Ski Legend- personal data service - 145 Chemin de Rovagny, 74290 Talloires-Montmin. The Client may request reimbursement of the stamp used to exercise this right by specifying this when sending his/her letter. The reimbursement of the stamp is made on the basis of the current slow rate, at the rate of one stamp per envelope.
In accordance with the provisions of the Data Protection Act of 6 January 1978, the Customer has at any time a right of access, opposition, rectification and deletion of your personal data. The Client may at any time exercise these rights by providing proof of his/her identity, by letter addressed to: 68'Ski Legend - Personal Data Department - 145 Chemin de Rovagny, 74290 Talloires Montmin. The Client may request a refund of the stamp used to exercise this right by specifying this when sending the letter. The reimbursement of the stamp is made on the basis of the current slow rate, at the rate of one stamp per envelope.

Article 17. Intellectual Property

All technical documents, products, drawings, photographs given to the Customer remain the exclusive property of Dynamic, the sole owner of the intellectual property rights on these documents, and must be returned to him at his request.
The Customer undertakes not to make any use of these documents that may infringe the supplier's industrial or intellectual property rights and undertakes not to disclose them to any third party.

Article 18. Force majeure

Are considered force majeure events those which, unforeseeable and irresistible, make the execution of the sales contract under the conditions provided for absurdly impossible.

All events of force majeure, as defined by regulations and case law, constitute a cause for suspension or termination of Dynamic's obligations if the event lasts more than one (1) month. Dynamic shall not be held liable for the non-performance of the concluded contract in the event of the occurrence of one of the aforementioned events.

Article 19. Applicable law

These GTC are subject to French law.
In the event of disputes, the Customer may, first of all, contact Dynamic in order to seek an amicable solution.
Failing an amicable agreement, the dispute shall be submitted to the courts of Annecy.
